What to do if your patient sue you?

Nowadays, the case number of lawsuits against doctors have been increasing. One of the contributing factor is the widespread use of information technology which makes people become more educated. The existence of legal loopholes in Indonesia Penal Code also cause doctors more vulnerable for being sued by patients or patient’s parents who are dissatisfied with the health services. The lawsuit may relate to ethical, disciplinary, and legal issues. This lawsuits case against doctor can involve many parties, including Honorary Council of Medical Ethics (MKEK), Honorary Council of Indonesian Medical Discipline (MKDKI), police, until the Ombudsman.
Indonesian Pediatric Society has two complementary agencies related to medical legal and ethical issues, the Agency for Development and Defense of Members (BP2A) and the Ethics Board (DE). The Agency for Development and Defense of Members (BP2A) is in charge of fostering members in health and medical law, medical ethics, and advocating members who have problem while carrying out their profession. On the other hand, the Ethics Board is responsible for the assessment of medical ethics implementation, including taking actions for members who violate honor and noble tradition of medicine (court function). Both of these agencies work together in performing their respective functions.
This topic will discuss more further about legal issues and medical ethics, the role of each professional organization and related institutions, and what efforts can be done if a doctor get a lawsuit when carrying out his/her profession. Discussion is expected to open doctor’s insight deeply into the medicolegal aspect to become a professional and ethical doctor in carrying out their duties.
